Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and MyBo ("MyBo", "we", "us", "our") that govern your access to and use of the MyBo mobile app, website, and related services (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who can use MyBo

You must be at least 13 years old to use MyBo. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. You confirm that the information you provide is accurate and that you may lawfully enter into these Terms.

2. What MyBo is

MyBo is a health and fitness journaling app. It lets you photo-log meals and workouts, build streaks, record exercise sets to receive an automated Form Score, store and review health information (such as body-composition scans and lab reports), connect wearables and health apps, chat with our in-app assistant (“Bo”), and optionally share progress with friends or a coach. Features may be added, changed, or removed over time.

3. Your account

• Keep your login credentials confidential and do not share your account.
• You are responsible for activity that happens under your account.
• Tell us promptly if you suspect unauthorized use.
• Provide accurate information and keep it up to date.

4. Not medical advice; assumption of risk

MyBo is provided for general fitness, wellness, and informational purposes only. It is not a medical device and does not provide medical, diagnostic, therapeutic, or other professional advice. The Form Score, corrections, Bo's responses, auto-detected macros, and similar outputs are automated estimates that may be inaccurate or incomplete and are not a substitute for a qualified trainer, physician, dietitian, or other professional.

Consult a qualified healthcare professional before starting or changing any exercise, nutrition, supplement, or medication routine, especially if you have a medical condition. Physical exercise carries inherent risks, including injury. You use MyBo and engage in any activity voluntarily and at your own risk. If you feel faint, dizzy, or in pain, stop and seek medical attention.

5. AI and automated features

Features such as the Form Score, pose tracking, Ask Bo, auto-detection, and document scanning (OCR) rely on machine learning and automated systems. Their outputs may be wrong, biased, or unsuitable for your situation. Do not rely on them for medical, safety, financial, or other significant decisions, and verify anything important. You are responsible for how you act on AI outputs.

6. Your content

You keep ownership of the content you create or upload — including photos, videos, pose data, logs, messages, and documents (“Your Content”). You grant MyBo a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, adapt, and display Your Content solely to operate, secure, personalize, and improve the Service for you — including generating your Form Scores and, where you choose to share, showing content to the people or coach you select.

You are responsible for Your Content and confirm you have the rights to it. Do not upload other people's personal or health information without their consent.

7. Privacy and sharing

Your use of MyBo is also governed by our Privacy Policy, which explains how we handle your information. Your personal logs, photos, and health data are private by default. Sharing anything — to the Feed, to a coach, or outside MyBo — is an explicit action you take, and you are responsible for what you choose to share.

8. Acceptable use

When using MyBo, you agree not to:

• Break the law or infringe anyone's rights;
• Upload content that is harmful, abusive, harassing, hateful, or deceptive;
• Upload another person's data without their permission;
• Impersonate others or misrepresent your affiliation;
• Reverse engineer, scrape, overload, or interfere with the Service or its security;
• Use the Service to build a competing product or to train machine-learning models without our written permission.

9. Coaches and third parties

If you connect a coach, you authorize MyBo to share the relevant data with them so they can support you. Coaches are independent third parties; MyBo does not employ them and is not responsible for their advice, conduct, or decisions. Likewise, third-party integrations you connect (such as WHOOP, Apple Health, Google Fit / Health Connect, Garmin, Fitbit, or Oura) are governed by those providers' own terms and privacy policies, and we are not responsible for them.

10. Plans, billing, and trials

MyBo may offer free and paid features. If we offer paid plans, the price, billing cycle, trial terms, and renewal conditions will be shown to you before you purchase, and purchases made through an app store are also subject to that store's rules. Unless required by law or stated otherwise, fees are non-refundable. We may change pricing or features prospectively with notice.

11. Intellectual property

The Service — including its software, design, look and feel, trademarks, and the content we provide — is owned by MyBo or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.

12. Termination

You may stop using MyBo and delete your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or to protect the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.

13. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any AI output will be accurate or reliable.

14. Limitation of liability

To the maximum extent permitted by law, MyBo and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or for personal injury, arising out of or relating to your use of (or inability to use) the Service or your reliance on any AI output. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid MyBo in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold MyBo harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

16. Changes to the Service and these Terms

We may modify the Service and these Terms from time to time. If we make material changes, we will update the “last updated” date and provide reasonable notice (for example, in the app). Your continued use of the Service after changes take effect means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of [governing jurisdiction — to be set by MyBo], without regard to its conflict-of-laws rules, and the courts located there will have exclusive jurisdiction, except where mandatory local law gives you other rights. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
